Planning Enforcement Proceedings
Planning Enforcement Proceedings involve steps being taken by the local authority against an individual(s) or company where in the opinion of the local authority there has been a breach of the Planning Acts.
Part VIII of the Planning & Development Act, 2000 has streamlined the procedures somewhat irrespective of the nature of the alleged offence.
There are strict time limits and it is important to make the necessary submissions promptly to avoid where possible unnecessary Court proceedings.
The local authority may where it deems it urgent and appropriate seek to bring Court proceedings immediately.
